Terms & Conditions

Article 1 – Definitions
In these terms and conditions, the following definitions apply:

  • Entrepreneur: ayéa, the owner of this webshop

  • Buyer / Consumer: a natural person who is not acting for business or professional purposes and makes a purchase through the webshop

  • Agreement: any purchase agreement between the Buyer and ayéa via the website

  • Product: the lash serum sold through the webshop

  • Withdrawal period: the statutory 14-day period during which the Buyer may cancel the purchase


Article 2 – Applicability
These terms and conditions apply to all offers by ayéa and to every agreement concluded.

Deviations from these terms and conditions are only valid if agreed upon in writing.

The terms and conditions are made available to the Buyer before placing an order, for example via a checkbox during the checkout process.


Article 3 – Offers and the agreement
All offers on the webshop are non-binding, subject to availability.

The agreement is concluded when ayéa confirms the Buyer’s order by email.

Ayéa aims to ship all orders within the indicated delivery time, currently 2–3 business days.


Article 4 – Price and payment
All prices on the webshop include VAT.

Payment can be made using the payment methods offered on the website.

Ayéa reserves the right to change prices, as long as the order has not yet been confirmed.


Article 5 – Delivery
Orders are shipped to addresses within the Netherlands and Belgium.

Shipping is free of charge.

The Buyer will receive a confirmation and, if available, a track & trace code once the product has been shipped.


Article 6 – Right of withdrawal (Returns / Cancellation)
The Buyer has the right to withdraw from the agreement within 14 days without giving any reason, provided the product is unopened.

For hygiene or health reasons (such as with cosmetics), the right of withdrawal may lapse once the product has been opened or used.

To exercise the right of withdrawal, the Buyer must inform ayéa by email within the withdrawal period.

Return shipping costs are the responsibility of the Buyer, unless ayéa has delivered an incorrect or defective product.

After receipt and inspection of the returned product, ayéa will refund the purchase price (excluding original shipping costs).


Article 7 – Warranty and conformity
The products delivered meet usual quality standards and are suitable for normal use as described on the webshop.

Any defects or errors must be reported to ayéa by email within a reasonable period (e.g., 14 or 30 days) after discovery.

Statutory consumer rights (such as warranty) remain in effect; these terms and conditions do not unreasonably limit those rights.


Article 8 – Liability
Ayéa is not liable for damage resulting from improper use of the product.

Ayéa cannot be held liable for indirect or consequential damage, except in cases of intent or gross negligence.

In the event of force majeure (e.g., shipping delays), ayéa has no obligation to compensate for delay or damage.


Article 9 – Complaints
Complaints regarding delivered products can be submitted by email within 30 days of receipt: hello@ayeacosmetics.com.

Ayéa strives to handle complaints within 7 days.

If a resolution cannot be reached together with ayéa, the Buyer may make use of a dispute committee or pursue legal action, depending on the situation.


Article 10 – Amendments to the terms
Ayéa reserves the right to amend these terms and conditions.

Changes will be communicated in a timely manner to the Buyer, for example by email or on the website.

New versions of the terms will be dated and published on the website, so it is always clear which version applies.


Article 11 – Applicable law and disputes
All agreements between ayéa and the Buyer are governed by Dutch law.

Disputes will first be submitted to the competent Dutch court, unless the Buyer has consumer rights that prescribe a different procedure.
